How can I get the withholding dividend back if I am an Australia tax resident?

As an Australian tax resident with investments in US shares, you may be subject to dividend withholding tax on income received from these investments.


The United States generally withholds tax at a rate of 30% on dividends paid to foreign investors. However, Australia has a tax treaty with the United States that reduces this rate to 15% for Australian residents.


To ensure you are taxed at this reduced rate, you typically would provide the appropriate documentation to the payer or the investment platform managing your US shares. This is usually done by completing a W-8BEN form, which certifies that you are an Australian resident for tax purposes and eligible for the treaty rate.


If you have already had 15% withholding tax deducted from your US share dividends, you do not "claim this back" in the sense that the US will refund this to you.


Instead, you can claim a foreign income tax offset for the tax withheld when you lodge your Australian tax return.
